Federal Employees File Lawsuit Against USDA Secretary Over Religious Messaging

Faith Revealed

According to Religion News Service, a group of federal employees has filed a lawsuit against United States Secretary of Agriculture Tom Vilsack, alleging that his use of agency communication channels to distribute Christian messaging violates the Establishment Clause of the First Amendment. The plaintiffs, who include several career staff members within the Department of Agriculture, claim that the secretary has incorporated religious language and themes into official internal emails and agency-wide announcements over the past year.

The legal complaint, filed in a federal district court, asserts that these communications create a workplace environment that favors one religious tradition over others. The employees contend that the secretary’s actions exceed the scope of his official duties and pressure subordinates to engage with religious content while performing their government responsibilities. The lawsuit seeks a permanent injunction to halt the practice and requests a declaratory judgment stating that the secretary’s actions are unconstitutional.

Legal representatives for the plaintiffs argue that the department has historically maintained a neutral stance regarding religious expression, a standard they claim has been compromised by the current leadership. The filing outlines specific instances where the secretary allegedly cited Christian scripture and encouraged staff to participate in religious observances during official working hours. The employees maintain that they filed the suit after internal complaints to the agency’s human resources office failed to result in a policy change.

A spokesperson for the U.S. Department of Agriculture stated that the agency does not provide comments regarding active litigation. Regarding the individuals who initiated the lawsuit, the spokesperson said, "We will keep the plaintiffs in our prayers during this process."

The Department of Justice is expected to represent the Secretary of Agriculture in the proceedings. The defendants have not yet filed a formal response in court, though the agency is required to submit its initial legal arguments by the end of the month. Both parties are currently awaiting a scheduling order from the presiding judge to determine the timeline for discovery and subsequent hearings. The case remains in its preliminary stages as the court reviews the initial motions filed by the plaintiffs.
